Viribus Unitis Krzysztof Sawicki Lawyer Legal and Business Consulting is an entity which has assembled a number of experienced lawyers, specializing in various fields of law: in the civil law, commercial law, labour and social insurances law, commercial companies’ law, public procurement law, public-private partnership, tax law and criminal law.
We have gained our experience in the scope of the fields of law referred to above providing legal services to institutional and business entities, as well as to natural persons. Representing the interests of our clients, we have participated in business negotiations, we have drawn up contracts, we have advised our clients in tax matters and we represented them before courts of all instances. Within the scheme of the comprehensively and immediately provided legal assistance, we have been engaged in particular in the following: handling cases before investigation and judicial authorities, preparing pleadings, participating in hearings and meetings, representing our clients before relevant institutions, such as insurance companies and local government bodies of all levels, drawing up draft contracts, rules, pre-litigation calls and representing our clients in enforcement procedures.
- In the field of the civil law, we draw up pre-litigation calls, we represent the interests of natural persons and business entities before institutions and courts of all instances in Poland, in lawsuits and non-litigious proceedings, in business and private cases; we represent our clients in enforcement proceedings and we assist them in obtaining compensations from insurance companies and other entities obliged to pay such compensations.
- In the field of the labour and social insurance law, we prepare and issue legal opinions on job contracts, managerial contracts, non-competition agreements and other documents connected with commencing employment relations or with employment as such. We advise in the scope of the selection of optimal ways to start and terminate relations between an employer and an employee. We draw up work rules, remuneration rules and other internal rules under the labour law. We provide services resulting from reconciliatory proceedings, as well as represent employees and employers in judicial and extrajudicial disputes resulting from the labour law and in disputes from the scope of social insurance.
- In the scope of commercial and business law, we provide legal services in the field of commercial companies’ code, business trading and registration of business entities in the National Court Register. We draw up draft statutes, rules and other legal documents, as well as we monitor the enforcement of contracts and the collection of debts due to our clients. We have the knowledge and experience necessary in the process of business negotiations.
- We have obtained the knowledge on the operations of the public procurement system working in e.g. central authorities, local authorities and other institutions obliged to comply with the Act – Public Procurement Code and providing legal serviced to contracting entities and contractors at each stage of the procedure. We cooperate with recognized authors of publications devoted to public procurement and civil law issues; furthermore, we are also engaged in training activities, concentrating on – without limitations – the analysis of the legal regulations in force in Poland and in the European Union from the scope of public procurement. Within the scheme of the legal services we have provided to our clients, we have been engaged in e.g. the analysis of documents provided by contracting entities to interested entities, in particular the analysis of the Terms of Reference, we have drawn up enquiries to the contents of the Terms of References, appeals and complaints, we have compiled bids, as well as represented contractors in procedures before the National Chamber of Appeal and in complaint procedures in courts.
- We are familiar with problems of the public-private partnership – we explored its mechanisms when providing legal services in this respect. We have been promoters of the concept of partnership as a method of financing and cooperation opportunities, according to market principles, by entities representing the public and the private sector.
- We have experienced the way the tax system works, in particular the issues from the scope of the goods and services tax VAT, by providing assistance to our clients in court penal revenue proceedings and proceedings conducted before relevant revenue authorities.
- We also provide legal assistance in cases from the scope of the penal law, in particular in penal commercial cases and in cases pertaining to public procurement. We have participated in each stage of a penal procedure, hence we have the necessary knowledge and experience in this respect.
